  1. Business Systems – Accounting Systems and Beyond: In 2011, the Defense Acquisition Regulation Council issued the much anticipated interim rule on Business Systems. It is expected that the interim rule will go final in 2012. In addition, DCMA and DCMA intend to issue their respective guidance on Business System audits and approval determinations during the year. In addition to defining the Business Systems requirements, the applicability of each system and the criteria for approved systems, the relatively new rule establishes regulatory requirements for withholds in situations where contractors are found not to have approved systems. The withhold provisions may have significant impact on contractors found to have deficiencies within their systems. As such, it is important for contractors to understand the new criteria and how they will be assessed.
  2. The New and Improved DCAA – Armed and Ready for 2012: We don’t have a crystal ball, but based on recent audits, publications and DCAA guidance we can venture to guess what DCAA’s audit focus will be in 2012. Guided by a new directive and aided with new regulations, the DCAA will audit contractors in new and improved manner. What can contractors expect as it relates to 2012 audit activity?
  3. Terminations – Prepare for (what may be) the Inevitable: As uncertainties continue to linger regarding the 2012 Government budget (and beyond) one thing remains clear – certain programs will come to end. Contractors across all agencies should be prepared for the possibility of terminations. Part of the preparation is ensuring contract accounting and reporting requirements are current, up to date and flexible enough to enable a contractor to submit a compliant and accurate termination claim that would allow for maximum recovery of costs in the unfortunate event of a termination.
